Terms and conditions of engagement – nutritional therapy services

PART 1

1. The Nutritional Therapy Descriptor

1.1. Nutritional therapy is the application of nutrition and lifestyle medicine sciences in the promotion of health, peak performance and individual care. Registered Nutritional Therapy Practitioners (RNTPs) assess and identify potential nutritional imbalances and understand how these may contribute to an individual’s symptoms and health concerns. This approach allows them to work with individuals to address nutritional imbalance and help support the body towards maintaining health.

1.2. Nutritional therapy is recognised as a complementary medicine and is relevant for individuals with chronic conditions, as well as those looking for support to enhance their health and wellbeing. Practitioners consider each individual to be unique and recommend personalised nutrition and lifestyle programmes rather than a ‘one size fits all’ approach.

1.3. Practitioners never recommend nutritional therapy as a replacement for medical advice and always refer any client with ‘red flag’ signs or symptoms to their medical professional. Nutritional therapists frequently work alongside medical professionals and will communicate with other healthcare professionals involved in the client’s care to explain any nutritional therapy programme that has been provided.

2. The Registered Nutritional Therapy Practitioner (RNTP) Requests that the Client Notes the Following:

2.1. The degree of benefit obtainable from nutritional therapy may vary between clients with similar health problems and following a similar nutritional therapy programme.

2.2. Nutrition and lifestyle recommendations will be tailored to support health conditions and/or health concerns identified and agreed between both parties.

2.3. RNTPs are not permitted to diagnose, or claim to treat, medical conditions.

2.4. RNTPs’ recommendations are not a substitute for professional medical advice and/or treatment.

2.5. Your RNTP may recommend food supplements and/or functional testing as part of your nutritional therapy programme and may receive a commission on these products or services.

2.6. Standards of professional practice in nutritional therapy are governed by the Complementary and Natural Healthcare Council (CNHC) Code of Conduct, Ethics and Performance.

2.7. This document only covers the practice of nutritional therapy within this consultation, and your practitioner will make it clear if he or she intends to provide services that are outside the scope of nutritional therapy practice.

3. The Client Understands and Agrees to the Following:

3.1. I am responsible for contacting my GP about any health concerns.

3.2. If I am receiving treatment from my GP, or any other medical provider, I should tell him/her about any nutritional recommendations provided by my RNTP. This is necessary because of any possible reaction between medication and the nutritional programme.

3.3. It is important that I tell my RNTP about any medical diagnosis, medication, herbal medicine or food supplements I am taking as this may affect the safety of the nutritional programme.

3.4. If I am unclear about the agreed nutritional therapy programme/food supplement doses/time period, I should contact my RNTP promptly for clarification.

3.5. I understand that the recommendations are personal to me and may not be appropriate for others.

3.6. I must contact my RNTP should I wish to continue any specified supplement programme for longer than the originally agreed period, to avoid any potential adverse reactions.

3.7. Recording consultations using any form of electronic media is not allowed without the written permission of both me and my RNTP.

3.8. It is my responsibility to ensure I have a working internet connection for online appointments. If I am unable to connect as scheduled, the appointment is considered a ‘no show’ and charged in full.

4. Confidentiality and Data Protection

4.1. The Registered Nutritional Therapy Practitioner will keep your personal information confidential and secure following the UK GDPR guidelines for the practice. The RNTP will not share your information with third parties without your consent. However, if the RNTP believes there is a risk of significant harm to yourself or another person, the RNTP may pass the information onto an appropriate authority using the legal basis of vital interest. A separate Privacy Notice and Data Protection is available for your review.

PART 2

1. Fees and Payment Terms

1.1. Fees are agreed in advance of the appointment. All consultation sessions require prepayment to be made 48 hours before a scheduled appointment, to allow time for the RNTP to be prepared.

1.2. Payments are processed securely and can be made by bank transfer, credit or debit card.

1.3. Prices are subject to change with reasonable notice.

1.4. The fees are inclusive of any applicable VAT and other taxes or levies which are imposed or charged by any authority.

2. Cancellation Policy

2.1. At least 24 hours notice is required to cancel or reschedule an appointment.

2.2. Late cancellations (under 24 hours) or non-attendance of an appointments will be charged in full.

2.3. If we need to rearrange an appointment we will give you at least 24 hours notice by email.

2.4. If you need to cancel or rearrange an appointment, please do so at the earliest convenience by emailing Elle Frizzell at: hello@ellefrizzell.com

2.5. It is the client’s responsibility to have a working internet connection for consultations via the arranged platform. Full consultation charges will apply for scheduled appointments that are unable to connect.

2.6. We have the right to cancel any contract for services for the following reasons:

  • Failure by the client to pay any monies due
  • The client’s behaviour is not reasonable or is offensive
  • Where we believe it is in the best interest of the client

2.7. In the case of advance payments for services, you have the right to cancel this agreement within 14 days of the purchase without penalty (‘Cooling-off Period’). If you wish to terminate the agreement within the 14-day Cooling-off Period, you must do so in writing to Elle Frizzell by emailing hello@ellefrizzell.com . The RNTP will refund any monies paid prior to cancelling this agreement. If the services have commenced during the 14-day Cooling-off Period, the RNTP will refund any monies due to you for services not yet provided. The refund payment will be made within 14 days of cancellation.

3. Circumstances Beyond Party Control (force majeure)

3.1. Neither Elle Frizzell nor the Client is liable for any failure or delay in performing obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to, industrial action, civil unrest, fire, flood, storms, natural disasters, acts of terrorism, acts of war, governmental action, or any other event that is beyond control of the party in question. If the delay continues for a period of 90 days, either party can terminate or cancel the services.

4. Supplement Recommendations

4.1. The RNTP may recommend dietary supplements as part of your personalised programme. Please note:

  • Recommendations are tailored to your individual needs and circumstances, including your medical history, symptoms, and current health status.
  • All supplements are optional and not a requirement of working with the RNTP.
  • Supplements are provided at an additional cost. The RNTP may receive a small commission on certain products.
  • Where possible, the RNTP will offer access to practitioner discounts.

4.2. The RNTP is not responsible for adverse reactions where supplements are taken outside of guidance or without disclosure of relevant medical information.

5. Functional Testing

5.1. The RNTP may recommend functional testing as part of your personalised programme. Please note:

  • Where applicable, the client is responsible for purchasing test kits and organising shipping
  • The RNTP may receive a small commission on certain tests
  • Results will be interpreted within the scope of nutritional therapy
  • Testing does not replace medical diagnostic procedures

6. Liability

6.1. The RNTP is not liable for:

  • Any decisions made based on information provided
  • Failure to follow recommendations
  • Outcomes related to undisclosed medical conditions, medications or nutraceuticals (supplements)
  • Failure of delivery of test samples, ordered by clients, to the appropriate laboratory

6.2. Nothing in these terms excludes liability where it is unlawful to do so.

7. Changes to Terms

7.1. The RNTP reserves the right to update these Terms and Conditions of Engagement at any time. Updates will be posted on our website.

8. Governing Law

8.1. These terms are governed by the laws of England and Wales.

We (the RNTP and the client) understand the above and agree that our professional relationship will be based on the content of this Agreement. We declare that all the information we share during this professional relationship is confidential and to the best of our knowledge is true and correct.
